Terms of Use (AGB)

These Terms govern the use of Orion Pay X and the OPX Bonus loyalty system. The system is designed for customer loyalty and marketing only. Loyalty points are not money and do not represent a financial claim.

1) Service Description

Orion Pay X provides a digital loyalty platform where participating stores may grant loyalty points to customers using a QR/ID-based scanner workflow. Customers can view their loyalty balance and present their QR/ID for point earn/redeem operations performed by stores.

2) Loyalty Points

Points are loyalty units only.
Points are not money, not e-money, and have no cash value.
Points do not constitute a bank deposit, investment, or legal financial claim.

3) Use of the System

Use is limited to participating stores and within system rules.
Misuse, fraud, automation, manipulation, or tampering is prohibited.
Attempts to interfere with security controls or system integrity may result in suspension or termination.

4) Store Participation

Participating stores are independent businesses. Store pricing, promotions, discount policies, and customer dispute handling are managed by the respective store. Orion Pay X is not responsible for store decisions or the quality of store offers.

5) No Cash Redemption / No Refunds

Points cannot be redeemed for cash.
Redemption is limited to discounts, promotions, or offers made available by participating stores.
No refunds or chargebacks apply to points operations.

6) Account & Security

You are responsible for maintaining the confidentiality of your account access.
Orion Pay X may suspend or terminate accounts if rules are violated or suspicious activity is detected.
We may require additional verification in cases of security concerns.

7) Availability & Maintenance

The service may be updated, paused, limited, or temporarily unavailable for maintenance, security measures, or technical improvements. We do not guarantee uninterrupted availability.

8) Limitation of Liability

Orion Pay X is not liable for damages resulting from misuse of the system, technical interruptions, store disputes, or circumstances beyond our control. This does not apply to liability for intent or gross negligence where mandatory by law.

9) Changes to Terms

These Terms may be updated from time to time. Continued use of the platform after updates indicates acceptance of the revised Terms.

10) Governing Law

These Terms are governed by the laws of the Federal Republic of Germany.

11) Severability Clause

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
